Fire Kate Campbell

FIRE KATE CAMPBELL

Kate Campbell is worse than incompetent, she's an unrepentant fraudster and menace to truth and justice. She deliberately disregards fact and law, wrecking havoc on people's lives and trust in the law, with immunity. She's unfit to be on any tribunal, much less a Vice Chair.

In an unusual move, CanLii cites an example of her work in The Owners, Strata Plan VR 293 v. Bains - Civil Resolution Tribunal (civilresolutionbc.ca) with "unfavourable mention" and "CRT Decisions" says this about it:

"Summary: The tribunal member ordered the applicant owner to pay half of the strata’s legal fees, because strata bylaws said that an owner would be liable for legal costs incurred by the strata as a result of a bylaw infract. The tribunal does not have jurisdiction to order reimbursement under section 173 of the Strata Property Act, as that jurisdiction lies solely with the BC Supreme Court."

It's just one example of Ms. Campbell's poisonous
disregard of the law.

In this case it is particularly flagrant and blatant in that Ms. Campbell cites
this particular law in most other cases, but arrogantly ignores it here, despite full knowledge of the SPA requirement that the strata must comply with section 189.4, which includes not charging dispute-related expenses against the owner.

Even first year law students know that an award for costs is the Supreme Court's jurisdiction. What's even worse is that in this case Kate Campbell ordered an owner to pay twice for what he already paid in strata fees, and not knowing any better, he DID IT.

It's disgusting to me the way the CRT routinely makes a mockery of the law at the expense of those who rely on and trust it.

************

Not that Kate Campbell could ever be trusted to respect fact or law when it doesn't suit her own agenda or ulterior motives to retaliate against exposure or criticism of adjudicator misconduct. I have direct personal knowledge that gives me reason to believe that most, if not all, of her work is contaminated.

This is a drawing of my patio, before and after Garth Cambrey, our property manager from 1988 to 2003, and now another CRT vice chair, told the neighbour they could extend their patio, and when they removed a tree to do so, told me that putting trellis planters on my patio was the only solution.

Kate Campbell ignored the primary issue and entertained the notion that my seeking a remedy was "reprehensible" in retaliation for my previous criticism of SPA violations against owners by herself and other members of the CRT when I applied for a 3-ft platform to get the planters off my patio when the CRT started operating. She ignored her duty to remedy significant unfairness and provide a s.33 remedy for contravention of the bylaws by the neighbour who bought in 2016 using common property illegally and interfering with my use and enjoyment without s.76 permission.

Please fire Kate Campbell and appoint Lynn Scrivener as Vice Chair.

Kate Campbell has demonstrated that she is evil, particularly in Bond v NW2671. Her disregard of the word "appropriate" in the Limitation Act in regard to proportionality and a reasonable nexus between the desired result and the measures required to reach that goal is characteristic of her  disregard of justice and fairness. The action she took against me in full knowledge that I was not in a position to challenge it by way of judicial review was shockingly disproportionate to the letter of the law and its potential for resolving disputes or affecting positive social change in strata life.

Also, please stop tribunal members with so-called "special expertise" in strata matters from acting as if they are ignorant of the law. Please educate them with the information that I have set out below for convenience of reference...

Fraud may consist as well in the suppression of what is true as in the representation of what is false. If a man professing to answer a question, select those facts only which are likely to give a credit to the person of whom he speaks, and keep back the rest, he is a more artful knave than he who tells a direct falsehood.
